South Africa reviews Israel response in ICJ genocide case over Gaza
Government studying Israel’s submission to international court
ISTANBUL — South Africa announced Sunday that it is reviewing Israel’s response submitted to the International Court of Justice in the ongoing genocide case related to the war in the Gaza Strip.
In an official statement, the Department of International Relations and Cooperation confirmed that Israel filed its response on March 12. The submission addresses South Africa’s earlier written arguments presented to the court under the Convention on the Prevention and Punishment of the Crime of Genocide.
Pretoria considers next legal steps
South African authorities said they will now carefully examine Israel’s response before deciding on the next stage of the legal process. Officials may either request permission from the court to submit additional written arguments or move directly to oral hearings.
According to the statement, the government will determine the most appropriate legal path after completing its review of the filing.
Concerns remain over ongoing violence in Gaza
The statement also pointed out that the humanitarian crisis in Gaza continues despite earlier rulings by the International Court of Justice. The court issued three binding orders that require Israel to prevent acts of genocide, allow humanitarian assistance, and comply with international law.
However, South African officials said the destruction and loss of life in the Gaza Strip continue.
Regional tensions raise broader security concerns
Officials also warned that growing instability in the region could worsen the crisis. They cited rising tensions in the Persian Gulf and ongoing Israeli military actions in Lebanon as developments that could expand the conflict.
According to the government, these factors pose serious risks to regional and global peace.
South Africa reaffirms commitment to international law
South African President Cyril Ramaphosa has repeatedly emphasized the country’s commitment to international law. Authorities stated that the government will continue to uphold the principles outlined in the Genocide Convention and the United Nations Charter.
Background of the genocide case
South Africa filed the case against Israel at the International Court of Justice on Dec. 29, 2023. The government accused Israel of violating the Convention on the Prevention and Punishment of the Crime of Genocide during its military operations in Gaza.
Due to the severe humanitarian conditions, South Africa also asked the court to impose urgent provisional measures.
In response, the court issued three separate orders on Jan. 26, March 28, and May 24, 2024. These rulings instructed Israel to take all necessary steps to prevent acts described under Article 2 of the convention. The court also ordered Israel to ensure that its military avoids genocidal actions, halt operations in Rafah that could create conditions for genocide, and submit regular reports detailing its compliance.
