Supreme Court Ruling Curbs Judicial Power but Leaves Trump Birthright Policy in Limbo

The U.S. Supreme Court recently issued a significant ruling that limits the ability of federal judges to block government policies nationwide while legal challenges are underway. Though seen as a broader legal win for President Donald Trump, the decision may not benefit him in a key area—his administration’s effort to limit birthright citizenship.

On his first day back in office this January, President Trump signed an executive order aimed at restricting birthright citizenship. However, three federal judges quickly issued nationwide injunctions, preventing the order from taking effect. They raised serious concerns about its constitutionality, pointing to language in the 14th Amendment, which grants citizenship to those born in the United States.

The order remains on hold as lower courts review whether the scope of the injunctions should be narrowed. The Supreme Court’s decision also imposed a 30-day delay on enforcement of the order, allowing opponents time to request continued legal protection from lower courts.
